Sears.com — 

 

On 12/29/07 - my husband and I were in Sears in Boise, Idaho. A nice sales associate named Seth helped us out. Seth mentioned to my husband that there was this great tool combo on sale that weekend only. I gave Seththe associate our gift cards to purchase this Craftsman 673 pc tool set and tool storage combo bundle Model H0168. He went online and gave us a receipt. We took the receipt from the store and called questioning the status of this order a few days later. First I was told due to the holiday rush - it would take a couple of extra days. Then I was told that everything was fine - the entire bundle would be shipped. Next I was told that Seth must have pushed a wrong button because the tools were not on the order - this was offensive because there was 1 Add To Cart button.   The next phone call I was told my order was hung up in the credit department, then I finally received my order confirmation. I called the store's General Manager who assured me he would look into it. Two days later I get a call from Ricky - a manager at Sears stating that he had spoke with his buyer and tools were no longer available and I should call Sears Consumer relations. Ricky didn't mention that he canceled the order. I called the GM, Mr. Godfrey,  at the store who told me I should review the TERMS OF USE link on the website which was interesting because his associate sold us the merchandise and he said to call Consumer relations. I called consumer relations and spoke with a VERY RUDE supervisor named Gail - who offered to sell me one of the tool sets for $699.00 (apparently they were in stock) and the 2 tools chest at FULL PRICE. This lady actually said to me "you don't expect us to honor this bundle price - do you?" My answer was yes because it was advertised that way.  The associate at the store told us about the GREAT AFTER CHRITSMAS SALE. She said that it was an error and "What part of what she said did I not understand". I asked for a substitute product - and was told no. I do have a documentation of this ad . I have never seen quite a scam like this or have I been spoke to in the manner Gail spoke to me . From the store, to the website, then to consumer relations - I was sold a product, given every answer in the book as to why I didn't receive the product and spoke to COMPLETELY unacceptable manner.... Oh yes and told to read the fine print. No email of error in advertising (if that was the case) - just basically too bad.

This is NOT good practice at all.I almost always have a good experience when I shop at Sears.This kind of behavior would make me think about going to other stores if it happened to me. There is NO reason for a customer to be treated in this manner.People who can not be curtious may not be the right person for this job.

So far, I've contacted the Better Business Bureau - who basically said Sears would be hiding behind their Terms Of Use statement and that I would only receive my money back. At least it shows a public dispute with the Better Business Bureau and I'm surprised more people didn't file complaints. I'm still looking into other options - such as filing a complaint with the Atty General. I hadn't thought about the FTC - but that also sounds like an option. This happened to a lot of people. Good luck and please keep me informed - I'll do the same!

I am going through this same thing right now with Sears. I purchased my set on 12/27/2007. Although mine was a 320 pc bundle with two chests. When I went to pick my order up they said there were no tools on the order. I then called Sears and there was some discrepancies but they did come out and admit that the bundle I purchased did include tools. They said that they would be shipping out the tools. Went back to the store and they had no idea what I was talking about. Called back to Sears and got transferred a supervisor by the name of Eric who told me that the tools were not included and that I could still get them but I would have to buy the combo at a 10% discount. I have the online ad showing this bundle at 299.98 that clearly states the tools are included.

Has anyone else had this problem. Any suggestions? Should I file a complaint with the FTC for false advertising?

then they violated the agreement here is what it says on their site "Once your order is submitted to us, we cannot change or cancel an order until your merchandise is received by you. All returns of merchandise are subject to Sears return policy, available under Returns/Cancellations." good luck. Ron

Since I paid at the store with Sears gift cards, the store points their fingers at sears.com - sears.com points at the store. The Tools Manager at the Boise store canceled my order - and the sears consumer supervisor Gail offered me to purchase at FULL price. So their great sale price was either false advertising or bait and switch. Their final answer to me was "read the Terms Of Use" disclaimer - they do not have to fill the order.

Since the store associate proceesed this on sears.com - I have the sears.com page stating this is paid - not a cash register receipt.

If you have a store receipt then you have no problem. I don't understand what their website has to do with any of this? If you have a store receipt that means it is paid for.
