Sealy Posturepedic Mattress — 

C&C MATTRESS just sold us what was supposed to be new Sealy Latex mattress. On Friday 1-23-09, it arrived but the delivery men refused to allow us to inspect mattress. C&C's website states: "REFUNDS ARE NOT AVAILABLE FOR ANY REASON, ONCE THE PACKAGING HAS BEEN OPENED".
After they left it we opened the box and discovered a SPLIT DOWN THE SIDE OF THE MATTRESS. The split was not a tear, but rather a foot long section that was not stitched CLOSED. It was stitched to it's own ends leaving the foam hanging out. We immediately phoned and spoke to C&C Mattress in New Jersey and advised them that the delivery men refused to allow us to inspect the mattress and that we found the defect as soon as we opened the packaging. We also immediately E-mailed pictures Peter Cancelli, the owner C&C Mattress within minutes of its arrival. After viewing the photos Cancelli replied via E-mail and agreed it was an obvious factory defect. On Monday, 1-26-09, he advised he REFUSED TO HONOR HIS guarantee and provide a replacement. He said he pay for a seamstress to come by and try to sew it. Because the defect is not capable of repair, we requested a replacement, but C&C Mattress said that a replacement would cut into his profit. Over a number of days Cancelli continued with his refusals stating that sewing was the only option. Finally, we contacted Discover Card and filed a dispute. After learning of the disputed charges Cancelli was furious. He threatened us that now we will get nothing unless we waived our credit card dispute in advance. WE DISCOVERED CREDIT CARDS WILL NOT HELP YOU IF YOU PURCHASED YOUR PRODUCT OUTSIDE OF YOUR HOME STATE. Now we are out over $2100.00 and stuck with a mattress that is falling apart. With more and more material falling out this mattress will be worthless in a few months.
C&C also charged my account for this defective mattress even though we phoned them and advised them of the defect on the day it was delivered. Sealy told us they don't warranty defective stitching and refused to honor their warranty .

My name is Peter Cancelli, the owner of C&C Mattress. Steve, from St Louis, received a mattress, which we had shipped to him. He signed for it as having received it in good condition. Later, her sent pictures of an open tape edge. I had no way of knowing if it happened while he was handling it, or if it had been incorrectly sewn at the factory. Just the same, for the sake of customer satisfaction, we offered to send out an upholsterer to sew it closed, but Steve wasn't happy with that...so, we ordered him a new mattress. The mattress was made and sent to our shipper a week later...on the same day we received notice from Steve's credit card company of his intent to stop payment. In the face of this, we stopped shipment. We told Steve that if he would reverse the chargeback, we would release the mattress for exchange.
We are currently in the middle of the stand-off that Steve created.

Furthermore, Steve has identified himself as a prosecutor and has threatened me, and I quote: 'I have no choice but to have this matter investigated by the New Jersey Secratary of State and Attorney General. I will pursue you both in State Court as well Federal Court for practicing in fraudulent interstate commerce.'

If Steve is, in fact, a prosecutor, It is likely to be illegal for him to abuse his authority of personal reasons.
